Testamentary trust and living trust
A testamentary trust starts after death. A living trust starts now. The choice is personal: our team learns your family structure first, then designs the trust with you.

Testamentary trust
Written into your Will by Alps Wills®. It starts on your death, and your trustee pays out on the terms you set.
- Drafted by Alps Wills®, in your WillWe write the trust terms into your Will, so there is one document to sign.
- Starts on your deathNothing moves while you are alive. Your estate or insurance payouts fund the trust.
- Your executor or guardian can be trusteeThe trustee need not be a company. Your executor, your children's guardian or a licensed trust company can act.
- Payouts on your termsBy age, milestone, amount or purpose.
Living trust
Set up and funded during your lifetime. Assets move to a trustee now and are managed on your terms, while you are alive and after.
- Starts when it is signed, not on deathThe trust exists from the day it is signed and funded, so it works while you are alive.
- Assets in the trust pass outside your WillAssets already in the trust do not wait for probate.
- A licensed trust company as trusteeA licensed trust company holds the assets and follows the conditions you set.
- Quoted after consultationFees depend on the assets and the terms of the trust.
FAQ
How much does a Testamentary Trust Will cost?
It depends on the structure. Alps Wills® quotes after a consultation.
When does a testamentary trust start?
On your death. Until then it is part of your Will, and you can change it whenever you update your Will.
Who can be a trustee?
A family member, a friend or a licensed trust company. Many families appoint two people, or one person with a trust company for larger or longer trusts.
Why use a testamentary trust for minor children?
An outright gift to a child is theirs in full at 21. A trust lets your trustee pay it out at the ages and on the terms you set.
Can a testamentary trust support a child with special needs?
Yes. A trust can pay regular support and medical and care costs to a dependant who cannot manage money alone, for as long as they need it.
What happens to the trust fund when the trust ends?
It passes to the remainder beneficiaries you name in your Will.
