FAQ

Who can apply for a Letter of Administration?

A family member entitled to a share, usually the spouse first and then the children. Anyone ahead of the applicant signs a renunciation.

How long does a Letter of Administration take?

The courts estimate about two to three months, depending on how complex the estate is.

Why do we need sureties?

Each administrator gives a bond backed by two sureties, to protect the beneficiaries. The court can waive them where they cannot be found and the adult beneficiaries agree.

How is the estate shared without a Will?

Under the Intestate Succession Act. A spouse alone takes everything; a spouse and children split it half and half, the children sharing their half equally; children alone share it equally.

When should we apply for a Letter of Administration?

The Family Justice Courts expect the application within 6 months of the death. A later application must explain the delay.

Does Alps Wills® file the application?

No. Alps Wills® is not a law firm. We prepare the papers with the family, and our partner lawyers file the application.
