FAQ
How long does probate take in Singapore?
Usually two to three months once the application is filed, longer if there are disputes, overseas assets or missing documents.
Who can apply for a Grant of Probate?
Only the executor named in the Will. If no executor can act, the court grants a Letter of Administration with the Will attached instead.
Do I need a lawyer to apply for probate?
Not always. A sole executor can file through the courts' Probate eService. Most families use a lawyer because the forms, affidavits and asset schedule must be exact.
Who pays the legal fees for probate?
Legal fees and court fees are paid from the estate, not by the executor personally.
What if the original Will cannot be found?
The court may grant probate of a copy if the executor proves it was properly signed, what it said and that it was not revoked. Otherwise the estate passes as if there were no Will.
What is on an executor checklist in Singapore?
The death certificate, the original Will, a Schedule of Assets with values at the date of death, a list of debts, and the assets that pass outside the estate, such as CPF and nominated insurance.
Does Alps Wills® file the probate application?
No. Alps Wills® is not a law firm. We prepare the papers with the executor, and our partner lawyers file the application with the Family Justice Courts.
